1. Eligibility

To use the Website you must be 18+ and able to form a binding contract, or 13+ with parent/guardian consent to this Agreement. The Website is not intended for children under 13.

2. User-Generated Content

You may upload photographs, comments, video clips, reviews, and other content (“Your Content”). Unless we say otherwise, by posting or submitting Your Content you grant Keywest a non-exclusive, royalty-free, perpetual, irrevocable, fully sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display Your Content and the name submitted with it, worldwide in any media now known or later developed. We may use any ideas or know-how in Your Content for any purpose, including developing and marketing products.

You represent and warrant that:

(a) you own or control all rights in Your Content;

(b) Your Content is accurate;

(c) use of Your Content does not violate this Agreement or harm any person or entity; and

(d) you will indemnify Keywest for all claims relating to Your Content.

We are not responsible for Your Content or third-party content. We may, but have no obligation to, monitor, edit, or remove content.

Consent to tracking technologies. You consent to our use of session-tracking technologies (e.g., clicks/touches, mouse movements, scrolling, keystrokes, device info, screen size) for analytics and experience improvements, and to our sharing such data with service providers for those purposes. 3. User Conduct

Use the Website lawfully and without infringing others’ rights or restricting their use. Without our prior written consent, you may not:

  • copy, reproduce, rent, lease, loan, or sell Website content;

  • modify, distribute, or repost content;

  • use content for any commercial exploitation.

You also agree not to:

(a) disrupt or abuse the Website, services, accounts, servers, or networks;

(b) disrupt others’ use;

(k) post content that is false, defamatory, abusive, hateful, obscene, profane, sexually oriented, threatening, invasive of privacy, or otherwise unlawful;

(l) submit products or ideas expecting confidentiality (see Product Submission Policies: submissions are non-confidential and may be used at our discretion without obligations);

(m) violate applicable laws.

4. Intellectual Property & License

Content available through the Website (text, graphics, software, music, sound, photos, videos, ads, and third-party content) is protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to view, copy, and print content solely to use the Website or place orders, provided you keep all notices intact. No other rights are granted by implication or otherwise. All rights not expressly granted are reserved.

We strive for accuracy, completeness, and timeliness but do not guarantee it. You assume all risk for actions based on Website information, services, or materials.

8. Purchasing Items

Product Representations. We may change specs, packaging, and prices without notice. We take reasonable precautions to describe products accurately, but do not warrant descriptions or packaging are error-free. If a product is not as described, your sole remedy is to return it unused/undamaged per our Return Policy.

Pricing Errors & Omissions. Prices, availability, and terms may change without notice. We may revoke offers and correct errors, including after an order is submitted/confirmed/charged. If we cancel after charging your card, we’ll refund the full amount.

Order Placement & Acceptance. Payment must be received before acceptance. We may request more information, or cancel/limit orders, including suspected resale orders. We do not sell to dealers/wholesalers/resellers. Fraudulent activity may be reported to authorities.

Shipping & Risk of Loss. Shipping/handling fees apply. We use commercially reasonable efforts to ship promptly; timing is an estimate and may vary with availability. If delayed beyond the stated date or beyond 30 days (if no date stated), we’ll try to contact you; if we cannot reach you or you no longer want the item, we’ll cancel and refund (typically within 7 business days for third-party credit cards). Title and risk pass to you upon delivery to the carrier. We may reject orders shipping outside the U.S.

Sales Tax. We collect applicable state/local taxes as required, which may include shipping/handling depending on the state. Tax is calculated at checkout for qualifying states.

Payment Information. You agree to provide true, current, and complete payment information that you are authorized to use. We may cancel orders or suspend/terminate accounts for inaccurate or fraudulent info. Electronic orders satisfy the Statute of Frauds.

International Orders. If we accept a non-U.S. order, you agree it is for personal use only, authorize us to arrange courier shipment, and agree you are importer of record responsible for taxes, duties, customs, and import requirements.

Returns/Refunds. Return items per the Return Policy or contact Customer Care: 561-602-5840 for assistance. Refunds are issued when products are timely returned/cancelled and, for third-party credit cards, typically within 5 business days of receipt.

9. Electronic Communications, Signatures & Records

By communicating with us via the Website or email, you consent to receive electronic communications from us, with the same legal effect as written communications. By clicking buttons such as “SUBMIT,” “DOWNLOAD,” or “I ACCEPT,” you provide a legally binding electronic signature and agree to this Agreement and any linked terms, consistent with the U.S. E-SIGN Act.

10. SMS/MMS Messaging Terms

By opting in, you agree to receive automated promotional and informational texts (SMS/MMS) from Keywest at the mobile number you provide. Carrier rates may apply. Consent is not a condition of purchase. Message frequency may vary; we may change volume, short code, or sending number.

Due to device/coverage variability, messages may be delayed/undeliverable. Neither Keywest nor carriers (including T-Mobile) are liable for delayed/undelivered messages.

We collect information such as your phone number/email, messaging history, and cookie-based data that may personalize your experience (e.g., cart reminders). By agreeing to these Messaging Terms, you also agree to our Terms and Privacy Policy.

Age & Eligibility. Same as Section 1.

Opt-Out. Text STOP at any time to opt out. You will receive a confirmation text. Only the keyword STOP will be recognized as an opt-out for this program. You may still receive texts from other Keywest programs unless you opt out of those separately.

Termination/Changes. We may suspend, terminate, or change the messaging service at any time, with or without notice.

11. Communications with Keywest

Calls to/from Keywest may be monitored or recorded. You verify your contact details are accurate and that you own/subscriber-control any numbers you provide. You consent to receive emails, prerecorded messages, and/or autodialed calls/texts regarding this Agreement, purchases, account matters (including collections), and promotions—even if your number is on a Do-Not-Call list. Carrier charges may apply.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KEYWEST AND ITS SUPPLIERS, PARENTS, SUBSIDIARIES, REPRESENTATIVES, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR SIMILAR DAMAGES (INCLUDING LOSS OF USE, PROFITS, DATA, GOODWILL, OR COST OF SUBSTITUTE SERVICES/ITEMS), WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE/STRICT LIABILITY), OR OTHERWISE, ARISING FROM:

(1) USE OR INABILITY TO USE THE WEBSITE;

(2) USE OR INABILITY TO USE ITEMS PURCHASED; or

(3) COST OF SUBSTITUTE SERVICES/ITEMS.

You agree to indemnify and hold harmless Keywest and its directors, officers, employees, agents, suppliers, parents, subsidiaries, and affiliates from any claims, losses, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from: (i) your use of the Website; (ii) information you submit; (iii) privacy/tort/telephone claims regarding numbers you provided that you do not own; and/or (iv) your breach of this Agreement.

14. Termination

We may suspend or terminate the Website or your access at any time, for any reason, without notice. Upon termination, the following survive: IP & license, indemnification, website information disclaimer, warranty disclaimer, limitation of liability, and arbitration/class action waiver (if applicable).

15. Changes to This Agreement

We may update these Terms from time to time by posting a new version on the Website without separate notice. Your continued use after posting constitutes acceptance. Check for updates whenever you visit.

16. Trademark Notices

KEYWEST STERLING SILVER COMPANY® is a trademark of Keywest Sterling Silver Company LLC. Other marks are the property of their respective owners. You may not use Keywest marks without our prior written consent.

17. Copyright/DMCA Policy

We respect intellectual property rights and may remove infringing content or terminate repeat infringers. If you believe your work has been copied in a way that constitutes infringement, please provide:

  1. A physical/electronic signature of the copyright owner or authorized agent;

  2. Identification of the copyrighted work;

  3. Identification of the allegedly infringing material and its location on the Website;

  4. Your address, phone number, and email;

  5. A statement of good-faith belief that the use is not authorized;

18. Other Important Terms
